Terms of Service

1. Definitions

• Operator, a barbershop, salon, or other business (and its staff) that uses the Service to manage bookings and accept payments.
• Customer, an individual who books an appointment with an Operator through the Service.
• Shop, an Operator's business location and listing on the Service.

2. Accounts & eligibility

You must be at least 18 years old to create an account. Customers verify their account using a mobile number and a one-time code; Operators create an account with an email and password. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account.

3. Bookings

Appointments are made with independent Operators that use barber.rsvp. The Operator, not barber.rsvp, is solely responsible for the services it provides and for setting its own payment, cancellation, no-show, and refund policies. barber.rsvp provides the software that facilitates bookings; it is not a provider of barbering or salon services and is not a party to the agreement between a Customer and an Operator.

4. Payments & Stripe Connect

Payments are processed by Stripe. Each Operator connects its own Stripe account and is the merchant of record for charges to its Customers. This means the Operator, not barber.rsvp, is responsible for fulfilling services, issuing refunds, handling chargebacks and disputes, and collecting and remitting any applicable taxes on its sales.

barber.rsvp facilitates these payments through the platform and may collect a platform fee and/or pass through payment-processing fees, as disclosed at sign-up or in the operator portal. We do not store full card numbers; card data is handled directly by Stripe under Stripe's terms. Customer payment questions and refund requests should be directed to the Operator.

5. Operator subscriptions & billing

Operators subscribe to a paid plan (e.g., Pro or Legion) to use the operator portal. Subscriptions may begin with a free trial. The following terms apply:

• Plans are billed in advance on a recurring monthly basis and renew automatically until cancelled.
• You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable, and we do not provide refunds or credits for partial periods, except where required by law.
• We may change plan pricing or features with prior notice; changes apply to the next billing period.
• If a payment fails, we may provide a short grace period and then suspend or disable access to the operator portal (including new bookings and edits) until the account is brought current. Your data is retained during this period subject to Section 13.
• Subscription fees are exclusive of any applicable taxes.

6. Referral program

Operators with an active subscription can share a referral link. The following terms apply:

• When a shop you refer signs up through your link and makes its first subscription payment, we add account credit equal to one month of that shop's plan to your barber.rsvp billing account. The shop you refer receives 50% off its first month.
• Referral credit is a promotional credit with no cash value. It is non-transferable, non-refundable, and can be applied only toward your barber.rsvp subscription charges. It is never redeemable for cash and cannot be applied to any other product or to an Operator's charges to its Customers.
• Credit is added to your billing account and automatically reduces your future subscription invoices. Unused credit carries forward to later invoices while your subscription remains active.
• Unused credit is forfeited when your subscription is canceled. On cancellation we remove any remaining referral-credit balance from your billing account. It has no cash value, is not refunded, and does not carry over if you resubscribe later.
• Credit is granted only for genuine referrals of new, unaffiliated Operators. We may withhold or reverse credit, and suspend participation, for referrals we determine to be self-referrals, duplicates, fraudulent, or otherwise abusive.
• We may change, limit, or end the referral program, or modify these terms, at any time; changes apply going forward.

7. SMS / Text Messaging Program

The program has two separate, independent opt-ins, each with its own consent box at booking, neither pre-checked:

• Transactional (required to book): recurring automated appointment reminders and tip links for your appointments (Venmo or Cash App), from barber.rsvp on behalf of the shops you book with.
• Marketing (optional, never a condition of booking): occasional win-back offers and discount codes from shops you've visited. You only receive these if you check the separate marketing opt-in.

Message frequency varies based on your booking activity. Message and data rates may apply.

Opt out at any time by replying STOP to any message; you will receive a confirmation and no further messages. For help, reply HELP or email support@barber.rsvp. Carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is not a condition of any purchase. Supported carriers include AT&T, T-Mobile, Verizon, and others; carrier support may change.

8. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• interfere with or disrupt the Service, or attempt to gain unauthorized access to any system or account;
• scrape, reverse-engineer, or copy the Service except as permitted by law;
• upload content that is unlawful, infringing, or that you lack the right to share; or
• use the Service to send unsolicited messages or to violate any applicable messaging, privacy, or consumer-protection laws.

9. Intellectual property

The Service, including its software, design, and content (excluding content you or an Operator provides), is owned by BullsAI LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain rights to content you provide (such as a Shop's name, photos, and service menu) and grant us a license to host and display it solely to operate the Service. If you send us feedback, we may use it without obligation to you.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for the services, conduct, or content of any Operator or Customer.

11. Limitation of liability

To the fullest extent permitted by law, barber.rsvp and BullsAI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $100.

12. Indemnification

You agree to indemnify and hold harmless BullsAI LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your violation of these Terms or applicable law, and, for Operators, the services you provide to and disputes with your Customers.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay subscription fees, or use the Service in a way that creates risk or legal exposure. Upon termination, your right to use the Service ends. Sections that by their nature should survive (including payment obligations, disclaimers, limitation of liability, indemnification, and governing law) will survive.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction, except where prohibited by applicable law.

15. Changes

We may update these Terms from time to time. We will update the “Last updated” date above, and material changes may be communicated through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.
